Scope and Purpose of this Privacy Policy
Uplift Canada Services ULC (” Uplift“, “we“, “us“, and/or “our“) is committed to the protection and safeguarding of the privacy and security of your personal information obtained by reason of your customer relationship with Uplift. Uplift uses this Privacy Policy to provide you with information about how our service works (the “Uplift Service” or “Service”), how we collect, use and disclose personal information in relation with our business in Canada. We also use our Privacy policy to set out our commitments regarding data collection, use and sharing for websites and applications that use the Uplift Service and reference this Privacy Policy, offer Uplift’s Pay Monthly, use the Uplift JavaScript tag, the Uplift Software Development Kit (SDK) and/or the Uplift Application Programming Interfaces (API’s), collectively (“Site” or “Sites”). This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources.
Your use of the Uplift Service and Sites is subject to this Privacy Policy. and to our Terms of Use. If you access one of our Sites, you agree to be bound by the terms and conditions set out in this Privacy Policy. If you do not agree, please do not access any of our sites.
Personal Information We Collect
Personal Information You Provide To Us
Personal information is information about an identifiable individual. Personal information includes, but is not limited to, your name, address, age, income, date of birth, gender, financial information and credit records, as well as your opinions, preferences and purchase patterns.. We collect personal information that is necessary to provide the Uplift Service. If you decide to apply for a loan using the Uplift Service, you must provide personal information. However, there is no requirement to apply for a loan with the Uplift Service.
When you complete a survey, provide feedback or contact us to obtain information about our Service, we may ask you to provide personal information, with your consent, that includes your name, email address and phone number.
We obtain your consent to collect use or disclose your personal information
Uplift obtains your consent to collect, use or disclose your personal information, except as otherwise permitted by law. Methods to obtain consent may depend on different variables and how sensitive the information is deemed. Consent may be oral or written, express or implied. Your express consent (verbal, written or electronic agreement) is generally obtained to collect, use or disclose sensitive personal information.
Note: If you withdraw your consent to certain uses of your Personal Information, we may no longer be able to provide services to you.
Information We Receive From Third Parties
We may receive information about you from third parties. As part of the credit underwriting process, we will obtain information about you, including your personal information and consumer reports, from credit reporting agencies. If you access the Service through a third-party website, application, referral or connection, that third party may pass on certain information about you and your use of its service to us, namely a user ID associated with your account, an access token necessary to access that service, your loyalty number, any information that you have permitted the third party to share with us, and any information you have made public in connection with that service.
Information We Collect Automatically
We may passively and automatically collect some information about your user profile with cookies, beacons, tags, scripts and local storage objects. Web browser documentation should be consulted to learn the proper way to modify cookie settings. If a web browser’s settings are set to delete, or not to accept cookies, some of the Service’s features may not work at all or to their fullest potential.
Your browser or mobile application may automatically report your log file information each time you access our Service. The following information is logged by Uplift when visiting our website: your web request, Internet Protocol (“IP”) address, browser type, operating system, device type, general geographical region, referring / exit pages and URLs, number of clicks, domain names, landing pages, pages viewed and other such information.
We may automatically collect additional information directly or using third party analytics tools such as loyalty number, other personally identifying information, product SKUs, payment method, first 6 and last 4 digits of a payment card, the payment card expiration date, the amount and currency of the transaction, the order confirmation number for the transaction and other details about the purchase.
Do-Not-Track Signals
Uplift does not process or respond to “do not track” signals or other similar signals whereby a visitor to a website requests that it disable collection of information about the visitor’s online activities over time and across different websites.
Information from Advertisements on Other Websites
We place and track advertisements on third-party websites. Like many advertisers, we advertise our products and services, and we contract with third parties to place advertisements, on websites not affiliated with us where we think the advertisements are likely to be most relevant. These advertisements may contain cookies or other mechanisms that allow tracking of your response to our ads. We and our contracted third parties track and report performance of our advertising and marketing campaigns by using cookies, web beacons, and other similar technology, which may be used to collect and store information about user visits, page visits and duration, and the specific ad or link that the user clicked on to visit the site. No personal information is stored during this process.
Accessing and Modifying Your Information
You can access, modify, correct, or delete your personal information by accessing your account at pay.uplift.com or by contacting us at the phone number or address indicated below, subject to certain legal and contractual restrictions that may apply. If you submit a request for access or rectification, we will, within 30 days of the date your written request is received, or such longer period as may be permitted by applicable law, respond to it. You are also entitled to submit a request for access or rectification to any credit bureau or any personal information agent who consults credit reports or recommendations as to your solvency.
Retention of Personal Information
We will retain your information for as long as your account is active, for the length of time needed to achieve the purposes for which it was requested, or as required by law. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
How We Use Your Information
We may use the information we collect for, namely, the following purposes:
- To provide, personalize, improve, and promote our Sites or Service, and to develop new products and services;
- To conduct research, monitor and analyze usage and trends;
- To post advertisements;
- To confirm consumer identities in an effort to limit fraud, jointly with identity verification services;
- To deliver content, remember your settings, better understand how our visitors navigate through the Site, learn what content is being reviewed, and administer the Site;
- To communicate with you, including for service-related purposes and marketing purposes (if you have opted-in to receive these communications) and to respond to your requests or inquiries;
- To enforce this Privacy Policy, our Terms of Use, and other terms you have agreed to, and to protect the rights, property, or safety of our Sites, Service, or any other person; and

How We Share Your Information
Accountability
Uplift is responsible for all personal information in its possession and under its control, including the personal information transferred to third parties for processing, storage or other purposes. Uplift has developed processes to achieve a robust privacy framework.
Service Providers and Other Third Parties
We share your information with service providers and other third parties such as identity verification services, credit reporting agencies and other data providers, servicing companies, collection agencies, customer support call centers, hosting and electronic payment service providers to perform functions and process data on our behalf. We may share your information with any of these service providers or third parties only as necessary to allow them to perform the services they have contractually agreed to provide us. Our service providers are required to keep your information private and secure and adhere to applicable provincial and federal laws and regulations.
How Your Credit History and Loan Data Are Shared
When you apply for a loan through the Service, attributes about your loan request may be made available to potential investors. This information includes personal and other necessary information about your loan request, as well as your, general geographic location, Uplift credit grade, and the purpose for which the loan will be used.
Qualified investors will also see certain credit data collected from or calculated based on your credit bureau file. It is necessary to allow prospective investors to see this information as they evaluate your loan request. The information displayed to investors includes a credit profile section and a credit history section. As noted above, this information may also be contained anonymously in loan data files available on the Uplift Service.
The credit profile section may include some or all of the characteristics below:
- FICO score range
- Goods or services being purchased
- Debt-to-income ratio (DTI)
- Gross income
- Home ownership status
- Current employer and tenure in your current position and/or source of income
- Existing debt payments (monthly snapshot of your current outstanding debt)
- Monthly payment amount for the loan being requested
The credit history section includes the following information:
- The date your earliest reported credit line was opened (e.g., revolving credit)
- The number of open credit lines currently in your credit file
- Your total balance for all open revolving credit lines
- Revolving line utilization rate, or the amount of credit you are using relative to all of your available credit
- The number of accounts on which you are now delinquent, and the past-due amount you owe
- The number of months since your last delinquency
- The number of 30+ days past-due incidences of delinquency in your credit file for the past 2 years
- The number of negative public records (e.g., bankruptcies and judgments, etc.) placed in your file and the number of months since the last record
- The number of inquiries by creditors during the past 6 months
If you successfully receive a loan through Uplift, we may also share detailed information about your loan including personal financial information, terms, payment performance, late payments, delinquency, defaults or collections activity to our investors, bank partners, loan servicers, referring merchants, subsequent creditors, ratings agencies, credit bureaus and/or consumer reporting agencies.
Other Information Sharing
We may also share your information:
- To the merchant or website on which you use Uplift’s Services;
- To provide marketing services on behalf of our merchant partners;
- To fulfill marketing offers such as loyalty points, discounts, perks and rewards;
- To provide customer service, resolve disputes and verify the accuracy of information;
- To third parties in anonymized or aggregate form;
- To any other third party with your consent to do so; or
- To an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction.
We reserve the right to disclose your personal information when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order or legal process served on our Service. We may also share your information with law enforcement or other government agencies as required by law, such as to comply with a subpoena, bankruptcy proceedings or similar legal process or for the purposes of preventing fraud or criminal activity or to protect your safety or the safety of others.
Limiting the collection of your personal information
Uplift collects the information required to provide services to you and as otherwise outlined in this Privacy Policy. Information must be collected by fair and lawful means.
Security
How we protect your personal information
We take commercially reasonable steps to protect information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. To that end, we use certain physical, managerial, administrative, and technical safeguards that are designed to protect the information that we collect and maintain. Please understand, however, that no security system is impenetrable and no method of data transmission can be guaranteed against any interception or other types of misuse. We cannot guarantee that the information that you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, e-mail sent to or from us may not be secure, and you should therefore take special care in deciding what information you send to us via email.
We employ session timeouts to protect your account. You will be logged out of the site automatically after a period of inactivity. This reduces the risk of others being able to access your account if you leave your computer unattended.
In the event that Uplift possesses, processes, stores or transmits cardholder data on behalf of a customer, Uplift will take commercially reasonable steps to ensure the cardholder data is secure.
Links to Other Web Sites
We are not responsible for the practices employed by websites or services embedded or linked to or from the Uplift Service or Sites, including the information or content contained therein. Please remember that when you use a link to go from the Uplift Service or Sites to another website or service, our Privacy Policy does not apply to third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link or advertisement on our website, are subject to that third party’s own rules and policies. Please consult the privacy policies on these sites before you provide them with any of your personal information. You agree that we are not responsible for any third-parties that you authorize to collect, use or share your information.
Social Media Widgets
Our website or service may include social media features, such as the Facebook Like button or other widgets. These features may collect your IP address, which site page you are visiting and may set a cookie to enable the feature to function properly.
Social media features and widgets are either hosted by a third party or hosted directly by our Site. Your interactions with these features are governed by the privacy policy of the organization providing it.
Testimonials
We display personal testimonials of satisfied customers on our site in addition to other endorsements. With your consent we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at customercare@upgrade.com
Security and Policy Change Notifications
From time to time, Uplift will send you email or text message (data rates apply) notifications as confirmations of particular actions you have taken. These are required elements of your transactions on our Service. These required notices are sent typically to notify you of a change in status, such as when you are confirmed as a borrower or for legal or security purposes. For example, certain notifications are sent for your own protection to ensure that no one can make a change to your account without your knowledge, such as confirming the addition of a new email address or linked external bank account. These notifications are sent to you so that you can be assured that no one is making changes to your account without your knowledge.
In other cases, these notifications involve changes to various legal agreements or site policies. Generally, you may not opt out of these service related messages.
You may adjust your preferences by logging into your account at pay.uplift.com or by following the directions provided with communications. Alternatively, you can opt out of receiving text messages by emailing customercare@upgrade.com or texting STOP/ARRÊT. Uplift reserves the right to close or limit access to your account should you opt out of the crucial notices that are required to perform the Uplift Service. You are still responsible for any amounts due to Uplift even if we close or limit access to your account.
Children’s Privacy
We do not knowingly collect personal information from children under the age of majority in their province/territory of residence (a “Minor”). If you have reason to believe that a Minor has provided personal information to us, please contact us, and we will endeavour to delete that information from our databases.
A person must be the age of majority in the relevant province/territory of residence to receive a loan through the Uplift Service. Any application received from someone who has not attained that age will be declined.
Compliance with Provincial and Federal Laws
This Privacy Policy may not constitute your entire set of privacy rights, as these may also vary from province to province. To be certain of your privacy rights, you may wish to contact the privacy commissioner in your jurisdiction that is charged with overseeing privacy rights of consumers. Certain regulations issued by provincial and/or federal government agencies may require us to maintain and report demographic information on the collective activities of our membership. We may also be required to maintain your personal information for at least seven years in order to be in compliance with applicable federal and provincial laws regarding record keeping, reporting, and audits.
Location of Hosting and Services
Our Sites and Service are hosted in the United States. If you choose to use them from other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your information outside of those regions to the United States for storage and processing. By providing your information, you consent to any transfer and processing in accordance with this Privacy Policy. We also may subcontract processing to, or share your information with, third parties located in countries other than your home country. Maintaining Openness of Policies and Practices
Uplift will make reasonable efforts to make information available to customers concerning the policies and practices that apply to the management of their information.
This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. By accessing and/or using the Uplift Service after we make any such changes, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the information is governed by the Privacy Policy in effect at the time we collect the information. Please refer back to this Privacy Policy on a regular basis.
